These Terms and Conditions (General Terms and Conditions) apply to the use of this website and/or any services offered, including the purchase of products, offerings or other services.
We therefore invite you to read these General Terms and Conditions carefully, to print them and/or to save them on a durable format, before placing any order, regardless of the procedure you will follow to finalize the contract.
1. GENERAL PROVISIONS
1.1 These General Terms and Conditions apply to any contract for sale of Polti products finalized in the United Kingdom territory, on the Website www.polti.co.uk between Polti UK (from now on, “POLTI”) and the Customer.
1.2 The Customer will be able to purchase the products available on the Website, by:
a) Following the appropriate purchasing procedure on the Website;
b) Calling the telephone number 0161 813 2765;
These General Terms and Conditions clearly state any particular condition applied to the use of the above purchasing methods. These General Terms and Conditions also apply to the circumstance of finalizing the contract by phone on POLTI initiative.
1.3 Purchasing POLTI products on the Website www.polti.co.uk is only allowed to those who have reached the age of 18.
1.4 The General Terms and Conditions are an integral part of the contract finalized between POLTI and the Customer (from now on also, “the Parties”).
1.5 POLTI reserves the right to change these General Terms and Conditions. In any case, those changes will be effective for the Customer since their publication on the Website and will apply exclusively on contracts finalized after their publication. Whether an updated version of these General Terms and Conditions is published on the Website, POLTI will include a link to the previous version.
2. ACCOUNT REGISTRATION AND PASSWORD
2.1 Except for phone orders, to purchase products on the Website, the Customer is required to register an account. For this purpose, POLTI will require personal details, residence, a valid e-mail address, a telephone number and any additional information in order to identify the Customer for the purpose of the contract. The Customer is also required to provide a delivery address for the purchased products.
It will be the Customer's responsibility to keep the provided information up to date and promptly notify POLTI of any changes.
Any requests for change / correction / addition / deletion of data may be forwarded to: enquiries.uk@polti.com.
The Customer is solely responsible for the truthfulness, accuracy and adequacy of the data provided. It is strictly forbidden to enter false and / or invented and / or fantasy, or third-person details. POLTI reserves the right to prosecute any violation and any fraudulent action against the company and / or to the detriment of other consumers. No responsibility can be ascribed to Polti for any error that may be contained in the fiscal documents sent to the Customer due to errors or omissions in the data provided by the Customer at the time of registration.
2.2 After registering on the Website, a password will be assigned to the Customer. The customer must understand that it has sole responsibility for the security of the Password; no responsibility can be attributed to POLTI in case of use of your password by third parties.
The Customer will also be solely responsible for the unlawful use of his password by third parties, not authorized; if the Customer has any reason to believe that his password has become known to someone not authorised to use it, please notify POLTI immediately at the above address.
2.3 It is understood that the data provided during the registration, the account and any other information provided by the customer during the purchase process will be handled by POLTI in full compliance with the Data Protection Act (1998). To this end, please read our Privacy Policy.
3. NOTIFICATION AND COMMUNICATION
3.1 By purchasing POLTI products on the Website www.polti.co.uk, the Customer agrees that POLTI will submit all notifications and communications related to orders to the e-mail address provided for this purpose at the time of the account registration.
4. WEBSITE UPDATES
4.1 POLTI is committed to constantly update the content on the Website and to provide users with true, clear, accurate and constantly updated information.
5. ORDERS
5.1 All purchase orders sent through the Website www.polti.co.uk must be completed in their entirety and must contain the necessary elements to the exact identification of the person making the order (Customer), the products ordered, their quantity, and the address where the delivery will take place.
5.2 Before the final confirmation of the order by the Customer, he may make changes, corrections, additions, or cancel the order. Once the order is submitted by the Customer and confirmed by POLTI, it will be considered as an irrevocable proposal to purchase.
Within two business days after submitting the order, POLTI will send a message to the Customer, to the e-mail address specified during the account registration, including the order summary. The Customer confirms the details of the order at the end of the purchasing process. By sending the order confirmation to the e-mail address specified during the account registration, POLTI accepts the proposal to purchase and finalizes the contract.
In case of contracts finalized by telephone, the Customer agrees that POLTI accepts the proposal to purchase by sending the order confirmation to the email address provided for this purpose statement. The contract is finalized when POLTI sends the order confirmation to the email address supplied by the Customer.
5.3 POLTI reserves the right to accept orders within the limits of available stock.
5.4 POLTI will not accept orders that are incomplete or not properly completed or not showing the minimum order quantities or exceeding the maximum quantities.
5.5 POLTI will not accept orders submitted by individuals and / or entities not residing in the United Kingdom.
5.6 POLTI also reserves the right not to accept orders that come from Customers who have previously unjustifiably refused to withdraw the products ordered or have not paid the full amount due in respect of previous deliveries.
5.7 In the event of unavailability of the product ordered for reasons not attributable to POLTI, although subsequent to the order confirmation sent by POLTI, the latter will promptly inform the Customer at the e-mail address or phone number provided at the time of the account registration, and refund any payment he may have already made.
6. PRODUCTS
6.1 The pictures of POLTI products on the Website are purely illustrative.
6.2 POLTI reserves the right to change the packaging and labeling of any POLTI product.
6.3 The products are not supplied for evaluation; the Customer is solely responsible for the choice of the products ordered and their relevance to his needs.
7. PRICES
7.1 The prices for each product are those specifically listed on the Website at the time of their selection for purchase. The product price and any additional cost related to the purchase will be indicated, in a clear and understandable way, also on the summary of the order. Before placing the order, the Customer will be required to confirm his order in the order summary.
All prices on the Website are in POUNDS STERLING, including VAT.
7.2 Prices are not including delivery charges that will be added to the total amount of the order on the basis of the rates posted on this site at the time of the order. Shipping charges will also be clearly indicated in the order summary that the Customer will have to confirm before placing the order.
7.3 POLTI reserves the right to modify at any time both prices and shipping costs, by publishing the new amounts on the Website: these changes will apply only to orders confirmed after their publication on the Website. POLTI reserves the right to cancel an order in case of obvious error in the system or in the data. In this case POLTI will immediately submit a notification to the e-mail address or phone number provided at the time of the account registration, and refunds any payment the Customer may have already made.
8. DELIVERY TERMS
8.1 POLTI use Parcel Force for the majority of its deliveries throughout the UK.
8.2 POLTI will deliver the purchased products to the address provided at the time of registration and confirm at the time of the order submission.
The sale and shipment of the products is done exclusively on the United Kingdom territory.
Most orders received Monday to Friday by the Internet or phone before 2.00pm will be dispatched for delivery within 3 to 5 working days. Occasionally during busy periods it may take an extra day to be despatched.
It is possible, however, that deliveries are delayed during periods of increased demand, in the event of adverse weather conditions or in the event of non-immediate availability of the product in stock. In any case, POLTI is committed to deliver products purchased no later than 30 days from the date of conclusion of the contract.
The carrier will make deliveries from Monday to Friday from 08:00 to 21:00.
Delivery times depend exclusively on the carrier and may vary depending on the location, the volume of goods and climatic conditions.

8.3 All risks of loss or damage to the Products, for reasons that are not attributable to POLTI, will transfer to the Customer when he, or a third party designated by him and other than the shipper / carrier, comes materially into possession of the purchased products.
8.4 In any case POLTI will not be liable for any delay or non-delivery attributable to the carrier or otherwise caused by circumstances beyond its control.
9. ABSENCE OF THE CUSTOMER AT THE TIME OF DELIVERY
9.1 In case of absence of the customer at the time of delivery at the place specified, a card will be left so that the Customer can arrange for re-delivery or pick up the delivery at his local YODEL depot.
Beyond the second attempt of delivery, the carrier will return the product to POLTI.
In this case, POLTI may withhold the shipping costs from what the Customer has already paid, and, within 30 days, will refund the difference.
10. WARRANTY AND NON-COMPLIANCE
10.1 If, at the time of delivery of the product, the customer becomes aware of any defects or discrepancies in the product packaging, he must report it immediately to the carrier and sign the delivery document conditionally. Any discrepancies in the product and / or any obvious defects must be reported to POLTI within 2 months from their discovery by your operator for a regular phone call, or by sending an e-mail to the following address: enquiries.uk@polti.com.
10.2 After ensuring the existence of the defects complained, POLTI will replace the goods, with delivery costs on its own.
10.3 If replacement of the product is not possible, the Customer may request the termination of the contract and the resulting refund of any amount paid.
10.4 Any replacement will be possible only after returning the delivery note enclosed in the parcel. The Customer is therefore obliged to maintain intact and legible, the delivery note.
10.5 The warranty does not apply if the faults found are due to improper storage subsequent to the time of delivery. For further details about the terms of warranty, please refer to the conditions of the manufacturer or call 0161 813 2765.
10.6 In any case, the warranty period lasts two years and starts from the date of delivery, resulting from the receipt confirming the purchase and delivery as explained in our Warranty Conditions.
11. TERMS OF PAYMENT
11.1 To ensure maximum safety to its customers, POLTI relies on the experience of PayPal and HiPay to handle all transactions. Both payment platforms guarantee high-level security and transactions take place on a secure server. During payment, you will be temporarily transferred to the platform site in order to submit sensitive data securely.
You can choose between the following payment methods:
a) Payment by Credit Card
b) Payment by PayPal
By filling in the form provided on the Site, you authorize POLTI to charge the total amount of the order, including shipping costs, on your credit card.
12. GIFTS AND PROMOTIONS
12.1 The promotions on the Website www.polti.co.uk are valid until stocks run out and within the purchase limits indicated.
12.2 Offered products may be delivered in promotional packs other than those published on the Website.
12.3 No replacement or return is possible for any goods received for free.
13. WITHDRAWAL RIGHT
13.1 If the Customer is not satisfied with his purchase, he may exercise the right of withdrawal and return, at his expense, the product purchased, without any penalty and without any obligation of explanation. The right of withdrawal may be exercised by the Customer within 14 days from the date on which the Customer or a third party, other than the shipper / carrier comes materially into possession of the purchased product.
13.2 In case he intends to exercise the right of withdrawal, the Customer must inform POLTI of its decision to withdraw from the contract a) by submitting the form made available by POLTI on the Website or b) by submitting any other unequivocal statement to that effect (for example, a letter sent by post or email). The form and any other unequivocal statement that would suggest the willingness of the Customer to terminate the contract must be sent to Polti UK Limited, The Junction - Merchants Quay, Manchester M50 3SG.
Both the form and the letter may also be sent electronically (by email address: orders.uk@polti.com). In the latter case, POLTI will send an acknowledgment of receipt of the withdrawal to the Customer, with no delay and on a durable format (eg, e-mail address provided at the time of the account registration).
13.3 The notice of withdrawal must clearly indicate the express will to withdraw from the contract, together with an indication of the order number and of the products for which the Customer intends to exercise the withdrawal.
13.4 Without undue delay and in any case within 14 days from the date on which the Customer has communicated to POLTI its decision to withdraw from the contract, the Customer must return the product, taking over direct shipping costs to Polti UK Limited ,The Junction,Merchants Quay, Manchester M50 3SG.
13.5 In case the Customer exercises his right of withdrawal, POLTI will refund all payments made by the Customer in its favour, including the cost of delivery. The refund will be issued no later than 14 days from the day POLTI has been informed about the intention of the Customer to terminate the contract. The refund will be made using the same payment method used by the Customer for the purchase, unless the Customer has specifically requested that the refund is made with other methods of payment, and unless the use of the same method in which it was made the initial purchase does not result in additional costs to the Customer.
POLTI also reserves the right to withhold the refund until it has received the product or until the Customer demonstrates that he has shipped the product, if such a demonstration has not taken place previously. If the value of the returned product is decreased as a result of use by the customer, other than the one necessary to establish the nature, characteristics and functioning of the product, POLTI reserves the right to ask the customer an amount equal to that impairment.

15. GOVERNING AND JURISDICTION
15.1 Contracts finalized through this website are governed by English law.
15.2 Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.
15.3 You may not assign, sub-license or otherwise transfer any of your rights under these General Terms and Conditions.
15.4 If any provision of these General Terms and Conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.
15.5 Only the parties to these terms and conditions may seek to enforce them under the Contracts (Rights of Third Parties) Act 1999.
